First: this is civil detention

ICE detention is civil, not a criminal sentence. There is no sentence to serve, so there are no sentence credits (good time) and no release date to calculate. Release depends on the immigration case: a bond, an immigration judge's decision, or an ICE decision.

There is no right to a free lawyer in immigration court. The law allows a lawyer "at no expense to the Government" (8 U.S.C. 1362 (opens in new tab)). Look for free or low-cost help on the EOIR list of pro bono providers (opens in new tab) and from accredited representatives (opens in new tab).

Watch for scams: a "notario" is not a lawyer in the U.S. Don't pay anyone who promises results. How to spot a scam.

Attorney Visits

Legal representatives of detainees may visit detainees

Monday - Friday: 8:30 a.m. - 8 p.m.

Weekends & holidays: 9 a.m. - 1 p.m.

Please call the detention center at (904) 259-3311 and speak to the receptionist in the detention lobby to schedule an attorney visit. Attorneys should always call in advance to schedule and ensure the legal visit can be accommodated on that day. If you plan on visiting several clients in one day, you will need to schedule each visit individually.

Detention Lobby Hours: 8:30 a.m. – 8 p.m.

Visits shall not exceed 1 hour.

A list of pro bono (free) legal organizations will be posted in all detainee housing units and other appropriate areas. This list shall be updated quarterly. If a detainee wishes to see a representative or paralegal from that organization, it is the detainee’s responsibility to contact them for an appointment.

Video Teleconferencing

Legal representatives may request video teleconference (VTC) meetings with their clients or prospective clients online at Homewav.com.

Before you can schedule a VTC visit, you will first need to set up an account on Homewav.com and submit an application to be a visitor as an Attorney. Please note that VTC attorney visits are conducted via a video kiosk or tablet, and are made privileged, meaning they will not be recorded in the Homewav system.

All video visitations are conducted in 20 minute increments.

The same guidelines for in-person attorney/client visits will apply to VTC meetings and legal calls. Only legal representatives, legal assistants, and interpreters will be allowed; no family or friends of the detained aliens are permitted. The legal representative and/or his/her agents may contact outside interpretation services during the call or session. To ensure confidentiality while maintaining security, a visitation officer will be stand within eyeshot but out of earshot outside of the private room where the VTC meeting takes place.

The officer will knock on the 5 minutes before the cut off time to allow time for the meeting to wrap up.
