First: this is civil detention
ICE detention is civil, not a criminal sentence. There is no sentence to serve, so there are no sentence credits (good time) and no release date to calculate. Release depends on the immigration case: a bond, an immigration judge's decision, or an ICE decision.
There is no right to a free lawyer in immigration court. The law allows a lawyer "at no expense to the Government" (8 U.S.C. 1362 (opens in new tab)). Look for free or low-cost help on the EOIR list of pro bono providers (opens in new tab) and from accredited representatives (opens in new tab).
Watch for scams: a "notario" is not a lawyer in the U.S. Don't pay anyone who promises results. How to spot a scam.

Friends and Family
On-site visitation hours:
8 a.m. to 5 p.m.
Monday through Friday, including all designated federal holidays
Visitors will not be processed after 4:30 p.m.
Alamance CDC provides time for each detainee to have visitation. Detainees are allowed two (2) visits per week (Sunday-Saturday) for up to fifteen (15) minutes of non-contact visitation with family and friends according to the schedule. If there are more visitors than can be accommodated in the visiting room, it may be necessary to limit visits to lesser periods of time. Visiting periods can also be shortened due to security risks, count, or other unanticipated events.
Visitors should only enter the facility with picture identification and no other property. Items such as purses, cell phones, money and wallets should be left secured in a vehicle.
Adult visitors must present a valid, verifiable government-issued identification card to enter the facility.
Minors who are visiting the facility must be accompanied by an adult guardian (18 years or older). Minors must not be left unaccompanied in the waiting room, visiting room or any other area.
Friends and Family Video Teleconferencing
Alamance CDC uses video teleconferencing via the HOMEWAV system. This service may be accessed, for a fee, via their website https://www.homewav.com/. Use of HOMEWAV is available 7 days a week from 8 a.m. – 8 p.m.
Attorney Visits
Legal representatives of detainees are authorized to have an on-site visit with their client 24 hours a day / 365 days a year. Legal representatives must present a valid, verifiable government-issued identification card to enter the facility.
A list of pro bono (free) legal organizations will be posted in all detainee housing units and other appropriate areas. This list shall be updated quarterly. If a detainee wishes to see a representative or paralegal from that organization, it is the detainee’s responsibility to contact them for an appointment.
Virtual Attorney Visitation | Video Teleconferencing
Legal representatives may request video teleconference (VTC) meetings or confidential legal phone calls with their clients or prospective clients by email at ACSOvisitation@alamance-nc.com. The receiving Officer will email back with a confirmed date and time. Please see the flyer for details.
The email should include:
Legal representative’s full name
Legal representative’s contact information, including phone number(s), email address, and Zoom account information
Detainee’s name
Detainee’s alien number
A few proposed times/dates for the requested VTC session
A scan of the legal representative’s government issued identification
A scan of the legal representative’s identification or documentation reflecting their status as an active legal representative, such as a state bar card, attorney license, paralegal license, or similar legal status.
A scan of the attorney’s DHS Form G-28 (unless this is a pre-representational)
If a legal assistant is the only legal representative to join the call, the email should also attach a letter of authorization on the firm’s/organization’s letterhead and a scan of the assistant’s identification.
Legal representatives may also schedule VTC meetings or calls by dialing (336) 570-6381. All appointments for VTC meetings or phone calls should be made 24 hours prior to the desired appointment time. Appointments are scheduled 9 a.m. to 4 p.m. and are in 60-minute increments. All appointments are contingent on availability. Legal representatives are not limited on the number of VTC appointments they can request, but no legal representative is permitted more than one 60-minute appointment with a detainee in a single day.
The same guidelines for in-person attorney/client visits will apply to VTC meetings and legal calls. Only legal representatives, legal assistants, and interpreters will be allowed; no family or friends of the clients are permitted. The attorney and/or his/her agents may contact outside interpretation services during the call or session. The sessions will be confidential; a visitation officer will be stationed outside of the confidential room to ensure security by standing out of earshot but within eyeshot. The officer will knock 5 minutes before the cut off time.
Electronic Exchange of Legal Documentation
When timely communication through the mail is not possible, the facility administrator may, in his or her discretion, allow for a reasonable amount of communication between the legal representative and their detained alien client.
For faxes sent by legal representatives to aliens:
The following fax number may be used to receive and transmit legal paperwork: (336) 570-6895.
Legal representatives transmitting documents must include a cover sheet containing the name of sender, the name of the Law Office, the address, the name and identification number of the detained alien, the sender’s return fax number, the number of pages and the date.
Incoming faxes will be placed in a sealed envelope with the alien's name and A-number written on the outside. The documents will be inspected for contraband but not read. The legal mail will be delivered to the alien. All facsimile legal electronic communication requests will be processed during normal business hours Monday through Friday excluding holidays. The transmission verification report which indicates that the fax was successfully sent will be maintained and filed by staff and a copy provided to the alien.
