North Carolina good time and sentence credit rules

Under North Carolina structured sentencing, people must serve the full minimum term. Earned time can only reduce the maximum term down to the minimum.[1]

Credit types and rates

  • Earned time is awarded by the Division of Prisons (or the local jail) under its rules. It reduces the maximum term.[1]
  • The minimum term must be served, except as provided in §15A-1340.18 (advanced supervised release).[1]

Exclusions and limits

  • Earned time cannot take the sentence below the minimum term.[1]

Parole eligibility vs. discharge

  • Structured sentencing has no discretionary parole. Release falls somewhere between the minimum and the maximum, depending on earned time. Felony sentences are followed by post-release supervision.[1]

How to find a release date

  1. Search the official NC DAC Offender Public Information by name or ID number.
  2. Look for the projected release, parole eligibility, or discharge date. The DOC record already includes credits it has awarded.
  3. For questions, contact the facility records office. Only DOC can correct a date.

FAQ

Can earned time get you out before your minimum in NC?

No. Under §15A-1340.13(d), earned time reduces the maximum term but never below the minimum.

Does North Carolina have parole?

Not for structured sentencing (offenses since Oct 1, 1994). Older sentences may still be parole-eligible.
